Constitutional Rights and Protections Charter

Adopted: June 28, 2026

Purpose

The Black American International Union (BAIU) recognizes that the Constitution of the United States protects the liberties of every American citizen. These constitutional protections are the legal foundation upon which our organization operates.

BAIU is committed to pursuing all of its objectives through peaceful, lawful, constitutional, democratic, and judicial means.

This Charter serves as a declaration of the constitutional rights exercised by BAIU, its members, officers, volunteers, and affiliated organizations.

Article I

Constitutional Foundation

The BAIU acknowledges:

• The Constitution of the United States

• The Bill of Rights

• Constitutional Amendments protecting liberty

• Equal protection under the law

• Due process

• Peaceful civic participation

Nothing contained within BAIU governing documents shall be interpreted as advocating violence, unlawful conduct, or the overthrow of any government.

Article II

First Amendment Rights

Every BAIU member possesses the constitutional right to:

Freedom of Speech

To openly discuss history, identity, ancestry, culture, politics, economics, science, genealogy, and public policy.

Freedom of Religion

To practice—or not practice—any religion without interference.

Freedom of the Press

To publish:

  • books
  • research
  • documentaries
  • websites
  • newspapers
  • podcasts
  • educational material

Freedom of Assembly

To peacefully gather for:

  • meetings
  • conferences
  • conventions
  • educational events
  • protests
  • rallies
  • memorials
  • cultural celebrations

Right to Petition Government

Members may petition federal, state, local, and international institutions for:

  • recognition
  • investigations
  • legislation
  • public hearings
  • civil rights protections
  • policy reform
  • reparative measures

Article III

Second Amendment

BAIU recognizes the constitutional right of law-abiding individuals to keep and bear arms as protected by the Constitution, subject to applicable federal, state, and local laws.

The organization encourages:

  • responsible ownership
  • lawful training
  • firearm safety
  • de-escalation
  • legal self-defense education

Article IV

Fourth Amendment

Members possess protection against:

  • unreasonable searches
  • unreasonable seizures
  • unlawful surveillance
  • unlawful property confiscation

BAIU supports education concerning constitutional protections during encounters with law enforcement.

Article V

Fifth Amendment

Every member possesses:

  • Due Process
  • Right to remain silent
  • Protection against self-incrimination
  • Protection against double jeopardy
  • Protection against unlawful government taking of property without just compensation

Article VI

Sixth Amendment

Every member possesses:

  • Right to counsel
  • Right to a speedy trial
  • Right to a public trial
  • Right to confront witnesses
  • Right to an impartial jury
  • Right to compulsory process for obtaining witnesses

Article VII

Seventh Amendment

Members possess the right to jury trials in qualifying civil cases as provided under federal law.

Article VIII

Eighth Amendment

Members possess protection against:

  • excessive bail
  • excessive fines
  • cruel and unusual punishment

Article IX

Ninth Amendment

The Constitution protects rights retained by the people beyond those specifically listed in the Constitution.

BAIU recognizes that constitutional liberties are not limited solely to the rights expressly enumerated.

Article X

Tenth Amendment

The Constitution reserves powers not delegated to the federal government to the states or the people.

BAIU supports lawful engagement with federal, state, tribal, and local governments consistent with constitutional principles.

Article XI

Thirteenth Amendment

The Thirteenth Amendment abolished slavery and involuntary servitude except as constitutionally provided following criminal conviction.

BAIU supports efforts to prevent all forms of unlawful forced labor, human trafficking, and modern exploitation.

Article XII

Fourteenth Amendment

The Fourteenth Amendment guarantees:

  • Equal Protection of the Laws
  • Due Process
  • Citizenship protections

BAIU views equal protection as a cornerstone of civil rights and advocates for equal application of the law to every person.

Article XIII

Fifteenth Amendment

No citizen may be denied the right to vote on account of race, color, or previous condition of servitude.

BAIU supports lawful voter participation and civic engagement.

Article XIV

Civil Rights Protections

BAIU supports enforcement of constitutional and statutory civil rights, including protections against unlawful discrimination in areas such as voting, housing, employment, education, and public accommodations, consistent with applicable law.

Article XV

Property Rights

BAIU supports the lawful acquisition, ownership, development, inheritance, and transfer of property.

Members are encouraged to:

  • own land
  • establish businesses
  • build institutions
  • invest in communities
  • create generational wealth

Article XVI

Freedom of Association

Members may freely:

  • create organizations
  • establish chapters
  • form educational institutions
  • establish charitable organizations
  • create businesses
  • develop cooperative enterprises

consistent with applicable law.

Article XVII

Equal Justice

BAIU advocates for:

  • Equal application of criminal laws
  • Equal access to courts
  • Equal treatment under the Constitution
  • Fair investigations
  • Fair prosecution
  • Fair sentencing
  • Equal access to legal representation

Article XVIII

Peaceful Civic Action

BAIU recognizes the constitutional right to engage in lawful civic participation, including:

  • peaceful protest
  • public education
  • legislative advocacy
  • litigation
  • voting
  • public office
  • community organizing

The organization rejects unlawful violence and encourages members to pursue change through constitutional and democratic processes.

Article XIX

Organizational Commitment

BAIU pledges that it shall:

  • Operate within the Constitution of the United States.
  • Respect the rights of all individuals.
  • Defend the constitutional liberties of its members through lawful means.
  • Promote education, economic development, cultural preservation, and civic participation.
  • Resolve disputes through dialogue, lawful advocacy, and the courts where appropriate.

Constitutional Oath of Membership

“As a member of the Black American International Union, I affirm my commitment to uphold and exercise the rights guaranteed by the Constitution of the United States. I will pursue the Union’s mission through peaceful, lawful, and democratic means, respect the equal rights of others, and work to strengthen my community through education, service, civic engagement, and constitutional advocacy.”
